These Terms of Service ("Terms") are an agreement between you and AiriWheels, Inc. ("AiriHub," "we," "us," or "our") governing your use of the AiriHub mobile app, the airihub.ai website, and related services (together, the "Service"). Please read them carefully.
1. Acceptance of these Terms
By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your region) to use the Service, and old enough to form a binding contract. By using AiriHub, you represent that you meet these requirements and that your use complies with all applicable laws.
3. Your account
- You are responsible for the information you provide and for keeping it accurate.
- You are responsible for maintaining the security of your account and any activity that occurs under it. Notify us promptly of any unauthorized use.
- You may not share your account, create an account for someone else without authorization, or maintain more than one account to gain extra rewards.
4. The Service
AiriHub lets you discover participating restaurants, check in when you visit, earn points and rewards, view a restaurant's specials and popular dishes through Airi, and — with your permission — see when friends are dining out. Features, participating restaurants, and rewards may change, vary by location, or be discontinued at any time. AiriHub is free for diners; we may introduce optional paid features in the future with notice.
5. Check-ins, points & rewards
- Verification. Check-ins may require location verification or a QR scan. You agree to check in only when you are genuinely present at a participating restaurant.
- Points and rewards have no cash value, are not transferable, are not your property, and cannot be exchanged for money except where required by law. They may expire and are subject to program rules that we or participating restaurants set.
- Redemption. Rewards and coupons are honored by participating restaurants and are subject to their availability, terms, and applicable law. We are not responsible for a restaurant's refusal to honor a reward.
- Adjustments. We may modify, suspend, or cancel points or rewards obtained through error, fraud, abuse, or violation of these Terms, and may change program rules at any time.
6. Acceptable use
You agree not to:
- Falsify check-ins, use bots or automated means, or otherwise manipulate points or rewards;
- Create fake or duplicate accounts, or impersonate any person or entity;
- Use the Service for any unlawful, harmful, fraudulent, or abusive purpose;
- Interfere with or disrupt the Service, or attempt to access it in an unauthorized way;
- Reverse engineer, scrape, or copy the Service except as permitted by law;
- Upload content that is illegal, infringing, harassing, or violates others' rights;
- Misuse other users' information, including information about friends who are dining out.
7. Participating restaurants
Participating restaurants are independent businesses, not AiriHub. Your meals, purchases, service, and any transactions are between you and the restaurant. We are not responsible for the quality, safety, pricing, or conduct of any restaurant, or for their honoring of rewards. Any disputes about your visit should be raised with the restaurant.
8. Intellectual property
The Service, including the AiriHub name, logo, software, text, and design, is owned by AiriWheels, Inc. or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not use our trademarks without our prior written permission.
9. Your content
You retain ownership of content you submit (such as a profile photo or feedback). You grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, and display that content solely to operate and improve the Service. You represent that you have the rights to the content you submit and that it does not violate any law or third-party right.
10. Third-party services
The Service may rely on or link to third-party services (for example, mapping, hosting, or app-store platforms). We are not responsible for third-party services, and your use of them is governed by their own terms and policies. Your use of the app may also be subject to the rules of the platform where you downloaded it (such as the Apple App Store).
11. Suspension & termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access, and remove points or rewards, if you violate these Terms, misuse the Service, or where we reasonably believe it is necessary to protect the Service, other users, or restaurants. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and governing law) will survive.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PARTICULAR REWARD OR RESTAURANT WILL BE AVAILABLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIRIWHEELS, INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR POINTS/REWARDS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
14. Indemnification
You agree to indemnify and hold harmless AiriWheels, Inc. and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law, to the extent permitted by law.
15. Governing law & disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, U.S.A., without regard to its conflict-of-laws rules. Subject to applicable law, you agree that any dispute will be resolved in the state or federal courts located in Massachusetts, and you consent to their jurisdiction. Nothing in these Terms limits any rights you may have under the mandatory laws of your place of residence.
16. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. If we make material changes to these Terms, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
